At Orenco Systems, Inc. (“Orenco”), we recognize that privacy is important. This Privacy Policy applies to all of the online products, services, and Web sites offered by Orenco or its subsidiaries or affiliated companies (collectively, Orenco’s “Online Services”). Personal Information

With regard to information about a user of any of Orenco’s Online Services, our privacy policy is clear: We will collect no personal information about you when you visit our Web sites unless you choose to provide that information to us. Here is how we handle information about your visit to our Web site:

Log Information

When you visit any of Orenco’s Online Services, our servers may automatically record information that your browser sends whenever you visit any Web site. This information does not identify you personally. These server logs may include information such as:

1.      The Internet domain and IP address (a number that is typically assigned to your computer by your Internet Service Provider whenever you are surfing the Web) from which you access our Web site;

2.      The type of browser and operating system used to access our site; or

3.      The date and time you access our site.

We use this information to help us make our sites more useful to visitors – to learn about the number of visitors to our Web site and the types of technology our visitors use. We do not track or record information about individuals and their visits.

Information You Provide

When you sign up for an Orenco Online Service that requires registration, we may ask you for personal information (such as your name, company name, contact information, e-mail address, and an account password). Orenco will only use personal registration information for purposes affiliated with the Online Service requiring registration, including:

1.      Providing our products and services to users, including the display of customized content;

2.      Auditing, research and analysis in order to maintain, protect and improve our services;

3.      Ensuring the technical functioning of our network; and

4.      Developing new services.

You can always decline to submit personal information to any of our Online Services, in which case Orenco may not be able to provide those Online Services to you.

Information Sharing

Orenco does not share personal information with other companies or individuals outside of Orenco, except in the following limited circumstances:

1.      We have your consent. We require opt-in consent for the sharing of any sensitive personal information;

2.      We provide such information to our subsidiaries or affiliated companies only upon compliance with this Policy and any other appropriate confidentiality and security measures; or

3.      We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to:

a.      Satisfy any applicable law, regulation, legal process or enforceable governmental request;

b.      Enforce applicable contracts or agreements, including investigation of potential violations thereof;

c.      Detect, prevent, or otherwise address fraud, security or technical issues; or

d.      Protect against imminent harm to the rights, property or safety of Orenco, users or the public as required or permitted by law.

Product Information

With regard to information about a product that is collected, stored, or managed by an Orenco Online Service, our policy is equally clear: Data or other information related to a product may be used by or disclosed to any party at the discretion of the owner of the data. However, we will not disclose personal information that may be collected as ancillary data to a product, such as the name of a purchaser or subsequent owner of a product, to any unrelated third party. Here is how we handle product information and personal information that is collected as ancillary data to a product:

Information Owned by Orenco

Data and other product information to which Orenco owns exclusive title and right, may be used by Orenco at its discretion for legitimate business purposes, including product or system analysis and management, statistical analysis, and marketing analysis and case studies. At its discretion, Orenco may also grant authorization to its dealers, distributors, business partners, operators, service providers, consultants, agents, and other parties as it sees fit, to use its data and other product information for legitimate business purposes.

Disclosure of Information Owned by Orenco

Orenco may, at its discretion, disclose data and other product information that it owns, provided that we will not, in good faith, disclose information that would provide a competitive advantage to competing companies or individuals associated with us. However, we will not disclose personal information that we own that was collected as ancillary data to a product, to any other company or individual outside of Orenco, except as required by a regulatory authority having proper jurisdiction over such product, or in the following limited circumstances:

1.      We have the written consent of the subject person to whom the information applies; or

2.      We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to:

a.      Satisfy any applicable law, regulation, legal process or enforceable governmental request;

b.      Enforce applicable contracts or agreements, including investigation of potential violations thereof;

c.      Detect, prevent, or otherwise address fraud, security or technical issues; or

d.      Protect against imminent harm to the rights, property or safety of Orenco, users or the public as required or permitted by law.

Information Owned by Others

Data and other product information that is collected, stored, or managed by an Orenco Online Service, but which is owned by you or any party other than Orenco, may only be used or disclosed by its owner and those parties authorized by the owner of the information. The owner of the information shall have full discretion and responsibility for any and all uses and disclosures that it makes or authorizes to be made.

Disclosure of Information Owned by Others

Orenco will only disclose data or other product information owned by you or any party other than Orenco that is collected, stored, or managed by an Orenco Online Service, including personal information collected ancillary to such product, in the following limited circumstances:

1.      We have the written consent of the owner of the information;

2.      We provide such information in strict compliance with the terms of an agreement with the owner of the information to share such information to a third party, such as a regulatory authority; or

3.      We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to:

    1. Satisfy any applicable law, regulation, legal process or enforceable governmental request; or
    2. Protect against imminent harm to the rights, property or safety or Orenco, users, or the public as required by law.

Information Security

We take appropriate security measures to protect against unauthorized access to, or unauthorized alteration, disclosure or destruction of, data contained in our Online Services. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal and product data.

We restrict access to personal information to Orenco employees, contractors and agents who need to know that information in order to operate, develop or improve our products and services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination, if they fail to meet these obligations.

Changes to this Policy

Please note that this Privacy Policy may change from time to time. We will not reduce your rights under this Policy without your explicit consent, and we expect most changes, if any, to be minor. Regardless, we will post any Policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, e-mail notification of Policy changes). Each version of this Policy will be identified at the top of the page by its effective date, and we will also keep prior versions of this Privacy Policy in an archive for your review.
